1. Introduction

These Terms of Service (the "Terms") govern the relationship between you, the user or customer (the "Client"), and La Palma Joa (referred to as "we," "us," or "our"), regarding the booking and purchase of Muay Thai training camps and associated services (the "Camp" or "Services") provided on La Palma, Canary Islands, Spain. By booking or purchasing any Camp through our website (the "Site"), you agree to be bound by these Terms, which constitute a legally binding agreement.

2. Legal Basis and Applicable Law

2.1 Governing Law

Governing Law: These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of Spain, including the Spanish Commercial Code (Código de Comercio) and applicable consumer protection regulations.

2.2 EU Compliance

EU Compliance: We operate in compliance with applicable European Union (EU) regulations, including the General Data Protection Regulation (GDPR) and EU consumer protection directives (including Directive 2011/83/EU).

2.3 Jurisdiction

Jurisdiction: Any legal action or proceedings relating to the Camps or these Terms shall be brought exclusively before the courts of La Palma, Spain.

3. Booking and Payment

3.1. Eligibility

Participants under the age of 18 may take part in the Camp provided that the booking and payment are made by a parent or legal guardian and a written parental consent and liability waiver is submitted prior to the Camp start date.

3.2. Reservation

The Client must select the desired Camp date and package on the Site. A booking is considered confirmed only upon our receipt of the required payment (either the full Camp Fee or a non-refundable deposit, as specified during the booking process).

3.3. Pricing and Payment

• All prices are quoted in Euros (€) unless otherwise stated.
• The Camp Fee includes only the services and elements expressly listed in the description of the selected package. The content of each package may vary and is strictly limited to what is specified in its individual overview.
• Flights, travel insurance, and personal expenses are not included unless explicitly stated otherwise.
• We reserve the right to change prices at any time; however, price changes will not affect bookings already confirmed.

3.4. Payment Methods

We accept payment via credit card, bank transfer, and PayPal. All payments are processed securely.

4. Cancellations, Refunds, and Changes

4.1. Client Cancellation

• All Camp bookings are non-refundable once confirmed.
• No cash refunds will be issued under any circumstances.
• The Client may request a one-time change of Camp dates, subject to availability, provided that the request is made at least 30 days before the original Camp start date.
• Date changes are offered as a courtesy and do not constitute a refund. An administrative fee may apply.

4.2. Cancellation by La Palma Joa

In the event of cancellation by us, the Client will receive a full refund of all monies paid for the Camp or may transfer the booking to a future Camp date. We are not responsible for any ancillary costs incurred by the Client, including flights, accommodation outside the Camp, visa fees, or insurance.

4.3. Changes to Booking

Changes to the booked dates are subject to availability and may incur an administrative fee.

5. Client Responsibilities and Safety

5.1. Insurance

The Client is required to obtain comprehensive travel insurance covering, at minimum, medical emergencies, accident cover, personal liability, and trip cancellation or interruption. We are not liable for medical or related expenses incurred during the Camp.

5.2. Health and Fitness

The Client confirms that they are in good health and possess the physical condition required to participate in intensive Muay Thai training. Participation is at the Client's own risk. We are not liable for injuries sustained during training or related activities.

5.3. Conduct

The Client must comply with all applicable local laws, customs, and rules of the training facilities and accommodation. We reserve the right to immediately terminate a Client's participation without refund if their behavior is deemed unsafe, disruptive, or detrimental to others or the Camp.

6. Limitation of Liability

To the maximum extent permitted by Spanish law, our total liability for any claim arising out of or in connection with these Terms or the Camp shall not exceed the total amount paid by the Client for the specific Camp concerned. We shall not be liable for any indirect, incidental, or consequential damages, including loss of profits or opportunities.

7. Data Protection (GDPR)

We collect and process personal data in accordance with the General Data Protection Regulation (GDPR). By accepting these Terms, the Client consents to the processing of personal data necessary for the provision of the Services. Further details are available in our Privacy Policy.

8. Amendments

We reserve the right to amend these Terms at any time. The version in force at the time of booking shall apply to the relevant Camp reservation. Updated Terms will be published on the Site.
